De nos jours, les avocats et les juristes chinois sont très friands d'Internet. Pourtant, leur utilisation de la Toile n'a pas encore été l'objet de recherches. Cet article veut apporter un regard nouveau sur le lien entre avocats, internautes et société civile chinoise. Les juristes ont trouvé en Internet, en particulier sur les blogs, un lieu d'information et d'échange où ils peuvent se dédier aux sujets qui les intéressent . Les multiples démarches qu'ils ont initiées au sein du Réseau ont (...) abouti à une mobilisation des moyens numériques, permettant de mieux communiquer et informer sur le système légal et judiciaire chinois. Leur utilisation d'Internet a-t-elle catalysé l'initiative personnelle des utilisateurs et mobilisé l'opinion publique ? Cet article s'attache à démontrer comment par le biais d'Internet les avocats ont pu être des acteurs du développement de la société civile et participer ainsi à l'émergence d'une « communauté de critères » relevant du droit.Nowadays, lawyers and jurists Chinese are very fond of the Internet. However, their use of the Internet has not yet been investigated. This article will provide a new perspective on the relationship between lawyers, surfers and Chinese civil society. Lawyers found in the Internet, especially on blogs, a place to exchange information and where they can devote themselves to topics that interest them . Multiple steps they have initiated within the network led to a mobilization digital means to better communicate and inform the Chinese legal and judicial system. Internet use did catalyzed users personal initiative and mobilized public opinion? This article aims to demonstrate how through Internet lawyers have been involved in development of civil society and thus contribute to the emergence of a "community standards" under the law. L'article se propose d'étudier la Francophonie dans la lumière de la transition post-communiste. L'objectif est d'opposer à l'approche quantitative, qui mesure souvent l'impact de la Francophonie dans les pays non francophones de l'Europe de l'Est par le nombre d'élèves, une autre approche qui cherche le lien entre la Francophonie et les problèmes stratégiques du développement des pays respectifs. The objective is to develop a different approach in opposition to the common quantitative one which consists of measuring the impact of Francophony by the number of students, an approach that focuses on its relations with the strategic problems of the respective countries. The prism is more the one of democratization rather than of cultural diversity. The article is structured in three parts. The first analyses voluntarism and the incoherence of the politics of adherence to Francophony, the second studies the new modalities and the last part deals with the emerging figures in civil society who are replacing the State in the implementation of Francophony locally. According to the PCCP thesis, the probability of a conditional A → C is the conditional probability P. This claim is undermined by Lewis’ triviality results, which purport to show that apart from trivial cases, PCCP is not true. In the present article we show that the only rational, “Dutch Book-resistant” extension of the agent’s beliefs concerning non-conditional sentences A and C to the conditional A → C is by assuming that P = P. In other cases a diachronic Dutch (...) Book against the agent can be constructed. There is a tension between our findings and Lewis’ results, which needs to be explained. Therefore, we present a probability space which corresponds in a natural way to the diachronic Dutch Book—and which allows the conditional A → C to be interpreted as an event in a mathematically sound way. It also allows to formalize the notion of conditionalizing A → C on ¬C which plays a crucial role in Lewis’ proof. Our conclusion is that Lewis’ proof is circular, so it cannot be considered to be a sound argument against PCCP. (shrink)

Adverse childhood experiences are prevalent in many western populations. Large studies have put the likelihood of having at least one ACE above 50% of the general population. ACEs and the associated experience of chronic stress, moreover, have been consistently linked with a variety of negative physical and psychological health outcomes across the lifespan from behavioral problems and cognitive difficulties early on, to greater chance of suffering from a mental health disorder and engaging in self destructing behaviors. The literature puts forward (...) several protective factors, such as mother-child relations, parental health, and community engagement. In this perspective paper we put forward the potential of regular nature engagement as a possible additional protective factor. Nature’s therapeutic potential has been well documented, for many psychopathologies and mental health difficulties. Yet studies looking at the protective and therapeutic potential of nature with people with ACEs are remarkably limited in numbers. In this perspective piece we conduct a search of the literature to find previous applications of nature as a protective or therapeutic intervention for people with ACEs. We highlight the gap in the current literature, and put forward various mechanisms of action that justify a closer exploration of this area in further research. (shrink)

This article is the first indepth ethical analysis of empirical studies that support the claim that children born without major parts of their cerebral cortex are capable of conscious experiences and have a rudimentary capacity for agency. Congenitally decorticate children have commonly been classified as persistently vegetative, with serious consequences for their well-being and opportunities to flourish. The paper begins with an explication of the rights-based normative framework of the argument, including conceptual analysis of the terms ‘agency’, ‘potentiality for agency’ (...) and ‘gradual approach of agency’. It critically examines Alan Gewirth’s account of the criteria for being a rights bearer and principles for settling rights conflicts between agents and potential agents. It then applies the rights-based normative framework to the ethical challenges associated with care for congenitally decorticate children. It argues that recent empirical studies support the claim that the concepts ‘potential for agency’ and ‘capacity for rudimentary agency’ apply to children who are born without major parts of their cerebral cortex. The article finally discusses important medical ethical implications of these results. It specifically focuses on congenitally decorticate children’s preparatory rights to a stimulating intellectual and social environment. (shrink)

Recent health legislation in Norway significantly increases access to specialist care within a legally binding time frame. The paper describes the contents of the new legislation and introduces some of the challenges with proliferations of rights to health care. The paper describes some of the challenges associated with the proliferation of legal rights to health care. It explains the benefits of assessing the new law in the light of a rights framework. It then analyses the problematic aspects of establishing additional (...) priority rules as solutions to rights conflicts. It then defends adequacy criteria for acceptable priority rules when such rules are unavoidable. It finally defends our proposed method and explores concrete applications. (shrink)

What is the nature of the underlying representations and mechanisms which allow very young children to acquire the words and structures of their native language? Our research looks especially at children between the ages of 3-5 when language acquisition still proceeds rapidly and uses multiple methodologies, including act-out tasks, truth value judgment tasks, and elicited imitation and production tasks.

Most people believe that death is bad for the one who dies. Much attention has been paid to the Epicurean puzzle about death that the rests on a tension between that belief and another—that death is the end of one’s existence. But there is nearby puzzle about death that philosophers have largely left untouched. This puzzle rests on a tension between the belief that death is bad for the one who dies and the belief that that death is not the (...) end of one’s existence. Many philosophers have responded to the Epicurean puzzle with the deprivation account of the badness of death, which seeks to make sense of the badness of death given that there is no life after death. This paper focus on the other puzzle, and advances the argument that the deprivation account can also make sense of the badness of death given that there is life after death. (shrink)

My goal in this paper is to argue that some cases of autobiographical remembering can be, and sometimes are, experienced aesthetically. Building on a Deweyan approach to the nature of aesthetic experiences, I show how Dewey conceived of aesthetic experiences as having a cumulative and progressive structure—I call experiences with such structure Deweyan experiences—and how that structure is replicated in some cases of autobiographical remembering in virtue of their having narrative structure. I also discuss the relationship between remembering and other (...) forms of narrative thinking and argue that not only it is easier for remembering to be experienced aesthetically, but also that only remembering can have the cumulative and progressive structure that characterizes Deweyan experiences. I conclude by showing how the Deweyan approach allows us to conceive of the aesthetic value of remembering in terms of the pleasurable or hedonic character of Deweyan experiences. (shrink)

The ability to be creative is often considered a unique characteristic of conscious beings and many efforts have been directed at demonstrating a relationship between creativity and the personality construct of psychoticism. The present study sought to investigate this link explicitly by focusing on discrete facets of creative cognition, namely the originality/novelty dimension and the practicality/usefulness dimension. Based on Eysenck’s conceptualisation of psychoticism as being characterised by an overinclusive cognitive style, it was expected that higher levels of psychoticism would accompany (...) a greater degree of conceptual expansion and elevated levels of originality in creative imagery, but would be unrelated to the practicality/usefulness of an idea. These hypotheses were confirmed in 80 healthy participants who were contrasted based on their EPQ psychoticism scale scores. Our findings suggest that the link between psychoticism and creativity is based on associative thinking and broader but weak top-down activation patterns rather than on goal-related thinking. This article is the first to bring into scientific discussion and to provide a historico-philosophical analysis of a manuscript “Neoplatonic Philosophy from the archive of Pamfil Danylovych Yurkevych. The reviewed manuscript belongs to P. D. Yurkevych’s handwritten nachlass stored in the funds of the Institute of Manuscript of V. I. Vernadsky National Library of Ukraine in the city of Kyiv. Additional archival materials are involved to answer several research questions. The author of this article provides arguments in favor of proving (...) that the manuscript is to be attributed to P. D. Yurkevych’s own handwriting, to be dated circa 1856, and that the purposing of its content is to be qualified as didactic. As it is established in the article, textual content of the manuscript in question is an original concise description and analysis of neoplatonic philosophy, which belongs to the set of materials created by P. D. Yurkevych in preparation for teaching the course on Ancient Philosophy in Kyiv Theological Academy during Kyivan period of his work. Turning to the inner critique of the manuscript, author of this article emphasizes an analysis that P. D. Yurkevych conducts concerning Plotinus’s ideas of the process of emanation of the world from the One and the role that philosophy has in true cognition. While comparing the manuscript “Neoplatonic Philosophy” with one of P. D. Yurkevych’s substantial philosophical works “Idea”, additional light is shed upon the prosess of genesis and development of Christian-Platonic worldview of the thinker. Furthermore, it is established that the manuscript in question played a major role in P. D. Yurkevych’s own schooling, particulary concerning his view on the philosophy of Plotinus, and his general reception of the Platonic tradition. (shrink)

Since the declaration of financial crisis in 2008, and the imposition of austerity measures in 2011, Greece has become an epicentre—or a “laboratory”—of multiple, successively declared crises, including the humanitarian crisis induced by the devastating effects of neoliberal structural adjustment policies. In this paper, I approach the explosion of crisis discourse as a medium for ideological negotiations of nation-state borders in relation to a continental project of securitisation. I suggest that ‘crisis’ functions as a lexicon through which sovereignty can be (...) reasserted in relation to supranational institutional interference in ostensibly democratic governance. Specifically, I examine how the refugee crisis and the debt crisis converge in nationalised space in Greece; that is, how in state discourse, ‘crises’ serve as a conduit through which the borders of an embattled nation are redrawn and hardened against threats from a political space conceptualised as ‘outside’ the nation. My point of entry is the declaration of the Greek government by the end of the summer of 2015, that it was “experiencing a crisis within a crisis,” dually victimised by migration ‘flows’ and failed European solidarity in a context of ongoing austerity measures required by its institutional lenders. The figure of ‘a crisis within a crisis’ functioned to delineate the boundaries of national space and time and to distinguish the normative victims of what are seen as distinct, if overlapping political phenomena (debt and migration), from those who parasitically share in, or indeed by their very illicit presence cause or contribute to the suffering of the national subject. If the global economic crisis had already been made ‘ours’ by being constructed as a problem inherent in the national economy, the global war on migration became reinvented as 'Europe’s crisis,’ and then ‘Greece’s.’ The nationalisation of ‘crisis’ then, has a triple function: first, to conceal the systemic and structural underpinnings of violent processes of dispossession and displacement; second, to authorise the imposition of regimes of management and securitisation; and third, to reify borders that simultaneously fortify the agencies of state sovereignties while containing those of embodied human beings. The figure of ‘nesting crises’—‘a crisis within a crisis’—emerges through gestures of ownership or territorialisation of crisis: that is, in the conditions under which, affectively and politically a ‘crisis’ becomes ‘ours’ rather than ‘theirs’ and, indeed, constitutes the ‘we’ and the ‘they.’ ‘Nesting crises’ discourse can be read as a vocabulary through which national sovereignty is reasserted and national unity reconstituted. In ‘The autonomy of the affect’ Brian Massumi wrote of the gap between affective and cognitive registering of the traumatic experience. Affect theorists and neuroscientists have long shared the notion of a gap between the somatic response to a traumatic event and the appraisal of the affective situation. This article develops theories on dissociation or nothingness, where nothingness is a measurement of the space between the affective and the cognitive registering of a traumatic event. It explores the concept of two (...) different systems, one a ‘conscious automatic’ system and the other an ‘intensity system’ that exists outside of normal physiological sequencing, beyond narration, and therefore incapable of integrating into memory systems. Abstrakt Analizy w zakresie starogreckich znaczeń słowa pathos skłaniają do postawienia tezy, że należy mówić o czterech głównych kontekstach, które ukształtowały rozumienie tej kategorii: o kontekście retorycznym, etycznym, tragicznym i emotywnym (passio). Chociaż wszystkie cztery wspomniane obszary pozostawały względem siebie stosunkowo niezależne, modyfikując sens pojęcia pathos w czasem bardzo odległych rejestrach czasowych, to można wskazać pewien wspólny rdzeń, determinujący charakter omawianej kategorii: mianowicie jej inherentną zakłóceniowość, kryzysogenność i afektywność. Pozostaje on w ścisłej relacji z odniesieniem patosu do doświadczeń bolesnych, nagłych, (...) zadziwiających, a także – tak, jak w ślad za Grekami czyni to Waldenfels – do stanów pasywnych, z których podmiot, pod wpływem patycznego ugodzenia, wybudza się jako żywo reagujący, cielesny „respondent”. Celem niniejszego artykułu jest prześledzenie owych starożytnych źródeł patosu i wskazanie ich współczesnych reminiscencji, rozbrzmiewających w Waldenfelsowskiej fenomenologii responsywnej. Struktura tekstu jest następująca: w pierwszej części przyglądamy się historycznym zastosowaniom pojęcia pathos (głównie w ramach tradycji greckiej); w części drugiej analizujemy patos pod kątem zdziwienia, uchodzącego według Platona i Arystotelesa za akt inicjujący myślenie filozoficzne; w części trzeciej, poświęconej fenomenologii Waldenfelsa, prezentujemy afektywny i cielesny wymiar doświadczenia patycznego, zradykalizowanego zarówno względem kartezjańskiego dualizmu, jak i Husserlowskiej teorii autoafekcji; w części czwartej powracamy do wyróżnionych wcześniej historycznych kontekstów patosu, aby pokazać, w jaki sposób Waldenfels na gruncie fenomenologii responsywnej aktualizuje je w ramach swojej polemiki z „klasycznymi” ujęciami doświadczenia i emocji. Background Professional care workers face ethical issues in long-term care settings (LTCS) for older adults. They need to be independent and responsible, despite limited resources, a shortage of skilled professionals, global and societal changes, and the negative reputation of LTCS work. Research aim Our aim was to describe the care workers’ lived experiences of ethical issues. The findings can be used to gain new perspectives and to guide decision-making to improve the quality of care, occupational well-being and nursing education. Research (...) design Focus group interviews were analyzed using a hermeneutic-phenomenological method. The analysis comprised three steps: naïve reading, structural analysis, and comprehensive understanding. Participants and research context We randomly sampled LTCS service providers in Finland and 53 care workers with different educational backgrounds from seven organizations participated in focus group interviews in 2021. Ethical considerations This was a sensitive study, which was connected to the participants’ individual views of the world, professional ethics and social and health care legislation. The participants' provided informed consent and their anonymity was guaranteed. Findings Care workers spoke about their lived experiences of ethical issues in an emotional way, using practical examples. They talked about how they were experts at caring and advocating for residents, balanced the responsibilities of their different roles, and defended their work to the wider society. The care workers said that ethical aspects of their work were too difficult to solve on their own. There were elements of their working environment and practices that caused unnecessary strain and they needed the commitment of managers, organizations, and society to solve ethical issues in LTCS. Conclusions Ethical issues were related to the well-being of both residents and care workers and reflected both internal and external pressures. Some issues could not be resolved by individuals and needed input from managers, organizations, and society. (shrink)

The notion of whether people focus on the past, present or future, and how it shapes their behaviour is known as Time Perspective. Fundamental to the work of two of its earliest proponents, Zimbardo and Boyd (2008), was the concept of balanced time perspective and its relationship to wellness. A person with balanced time perspective can be expected to have a flexible temporal focus of mostly positive orientations (past-positive, present-hedonistic, and future) and much less negative orientations (past-negative and present-fatalistic). This (...) study measured deviation from balanced time perspective (DBTP: Zhang, Howell, and Stolarski, 2013) in a sample of 243 mature adults aged 45 to 91 years and explored relationships to Retirement Planning, Depression, Anxiety, Stress, Positive Mood, and Negative Mood. Results indicate that DBTP accounts for unexplained variance in the outcome measures even after controlling for demographic variables. DBTP was negatively related to Retirement Planning and Positive Mood and positively related to Depression, Anxiety, Stress and Negative Mood. Theoretical and practical implications regarding balanced time perspective are discussed. (shrink)

Recent research has demonstrated an asymmetry between the origins and endpoints of motion events, with preferential attention given to endpoints rather than beginnings of motion in both language and memory. Two experiments explore this asymmetry further and test its implications for language production and comprehension. Experiment 1 shows that both adults and 4-year-old children detect fewer within-category changes in source than goal objects when tested for memory of motion events; furthermore, these groups produce fewer references to source than goal objects (...) when describing the same motion events. Experiment 2 asks whether the specificity of encoding source/goal relations differs in both spatial memory and the comprehension of novel spatial vocabulary. Results show that endpoint configuration changes are detected more accurately than source configuration changes by both adults and young children. Furthermore, when interpreting novel motion verbs, both age groups expect more fine-grained lexical distinctions in the domain of endpoint configurations compared to that of source configurations. These studies demonstrate that a cognitive-attentional bias in spatial representation and memory affects both the detail of linguistic encoding during the use of spatial language and the specificity of hypotheses about spatial referents that learners build during the acquisition of the spatial lexicon. Fifty years after the death of Edmund Husserl, the main founder of the phenomenological current of thought, we present to the public a four book collection showing in an unprecedented way how Husserl's aspiration to inspire the entire universe of knowledge and scholarship has now been realized. These volumes display for the first time the astounding expansion of phenomenological philosophy throughout the world and the enormous wealth and variety of ideas, insights, and approaches it has inspired. The basic commitment to (...) phenomenological concerns found in all this variety makes this collection a most signifi cant historical document. This second volume of the collection bears witness to a deliberate shift of attention from the earlier to the later phase of Husserl's reflections. We see how his issues - intersubjectivity, ethics, human encounter, the societal world, empathy, the sphere of the self, and the surpassing of dichotomies (bodylpsyche, etc.) - are now at the center of attention in the human sciences. Among the authors are H. Tellenbach, A. Rigobello, C. Balzer, C. Bjurvill, V. Molchanov, E. Syristova, O. Balaban, R. Boehm, M. Sancipriano, O. M. Anwar, Y. Okamoto, B. Holyst, T. Sodeika, and M. De Negri. The studies were gathered at the programs held by The World Institute for Advanced Phenomenological Research and Learning in the commemorative year 1988/1989, chiefly at the First World Congress of Phenomenology at Santiago de Compos tela, Spain, with the aim of assessing the current state of phenomenology.
